Terms and Conditions for Uploading Content

Dear Gonser Community,

Gonser AG, Bahnhofstrasse 4, 6048 Horw, Switzerland asks for your consent to share your "work", image or moving image (video), on our online shop Gonser.ch and our social channels, such as Instagram, Facebook and Tiktok.

In return, we offer to share and publicise your work on our website and/or on our social channels.

In order to use your image for commercial purposes, we would like to obtain your express consent. We obtain express consent based on the following points:

I. By sending your work to our e-mail address community@gonser.ch and/or commenting on the work on Instagram or Facebook with the hashtag #mygonser, you grant us the following rights of use free of charge and unlimited in terms of content, time, or place:

• to fully use, edit, adapt, and exploit your work on our website and on our accounts, including for commercial marketing purposes. This grant of rights expressly includes all known and unknown forms of internet offerings;
• the unrestricted right to reproduce, make publicly available and publicly display your work, in particular through the digital integration of your image on our social channels and websites;
• the advertising rights, i.e. the right to use the work for advertising purposes, more specifically to advertise Gonser AG and the products that Gonser AG offers on its websites and in all other media, including outside the Internet, in particular in print media and in our newsletters;
• the right to make the work publicly available, i.e. the right to keep the work and make it available to the public, whether in analogue or digital form, and
• the right to use your work in connection with other works.
  

II. You confirm that you are the owner of the rights granted under I and that it is possible for you to effectively grant us these rights.

III. Furthermore, you confirm that no personal rights of third parties are infringed by the use of your work, in particular that any persons depicted consent to the use of your image in accordance with the contract.

IV. You release us from claims by third parties, in particular from claims arising from copyright and personal rights infringements, which may be asserted against us in connection with the exercise of the rights arising from this contract. If you become aware of an infringement of the agreed rights, you must notify us immediately.

V. For the use and distribution of your work on our accounts, we only process the necessary data, i.e. your work tagged with the hashtag #mygonser or sent by email to community@gonser.ch, your account name and other data that you may have published in connection with social media (e.g. your email address). This is done to recognise your work.

VI. Either party may revoke this agreement in writing or electronically within two weeks, via e-mail to: community@gonser.ch

VII. Any amendment or addition to this agreement must be made in writing or in electronic form. Should a provision of this agreement or part thereof be or become invalid, this shall not affect the validity of the remaining provisions of the agreement. Insofar as a choice of law is permissible, this agreement shall be governed exclusively by Swiss law.
